Terms and Conditions of Service

Welcome to Native Experience (“Company,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access and use of our website native-experience.com (the “Site”) and any services, activities, or bookings made through it (collectively, the “Services”). By using our Site or Services, you agree to these Terms. If you do not agree, you must not use the Site or Services.
The terms “you” and “your” refer to any user of the Site or participant in our Services.
1. Agreement to Terms
By accessing or using the Site or booking Services, you confirm that you:
Have the legal capacity and authority to enter into these Terms.
Will comply with all applicable laws and regulations.
Accept responsibility for all activity conducted under your account or booking.
2. Intellectual Property Rights
Unless otherwise indicated, the Site and all content (text, graphics, logos, software, and images) are the property of Native Experience and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use. You may not reproduce, distribute, or create derivative works without our prior written consent.
3. User Representations
By using the Site or Services, you represent and warrant that:
All information you provide is true, accurate, and complete.
You will not use the Site for any unlawful or unauthorized purpose.
Your use will not violate any applicable law, regulation, or the rights of others.
4. Privacy
Your use of the Site is also governed by our Privacy Policy, available on a separate page. By using the Site, you consent to the collection and use of your information as described in that policy.
4.1 Security & Information Safety
Native Experience will never request your personal banking details, login credentials, passwords, or sensitive personal information through email, phone, or WhatsApp.
We will also never request full payment in advance for activities unless explicitly stated and agreed in writing for certain tour packages.
Payments are only made via official channels – by bank transfer to our verified company account in Sri Lankan Rupees (LKR).
If you receive any suspicious communication claiming to be from Native Experience, please contact us immediately at info@native-experience.com.
5. Booking and Payments
Bookings for activities are only confirmed once a deposit has been received (unless otherwise agreed in writing).
Deposits are non-refundable for certain tour packages. You will be notified of this at the time of booking.
Payments are accepted via bank transfer in Sri Lankan Rupees (LKR) only.
Partner fees and deposit requirements may vary depending on the activity. These will be communicated to you before we accept payments. However, if a partner later changes their terms or fees, Native Experience cannot be held responsible.
You are responsible for ensuring that all booking details provided are accurate. Incorrect details may result in cancellation without refund.
6. Cancellation & Rescheduling
6.1 Customer Cancellations
Many of our activities require advance booking with local guides, transport providers, or third-party partners. Because of this, cancellation terms may vary depending on the specific service.
We will inform you of applicable cancellation terms at the time of booking. Refund eligibility will depend on the policies of the service provider and whether a non-refundable deposit applies.
Once a booking is confirmed, refunds for cancellations may be partial or unavailable, depending on the arrangements already made on your behalf.
6.2 Company Cancellations or Changes
Certain services may need to be rescheduled due to weather, safety conditions, or third-party availability.
In such cases, we will make every effort to provide you with an alternative date or service.
If no alternative is possible, you will be offered a refund of any payments made to us (excluding non-refundable deposits and third-party fees, if applicable).
6.3 Force Majeure
We are not responsible for cancellations or changes due to events beyond our reasonable control, including weather disruptions, strikes, natural disasters, or government restrictions.
In such cases, we will work with you to reschedule where possible, but refunds may be limited.
6.4 Communication
Any cancellation or rescheduling requests must be sent to info@native-experience.com with your booking details.
7. Assumption of Risk and Liability Waiver
Many of our activities (including but not limited to trekking, paragliding, and adventure travel) involve inherent risks such as physical exertion, outdoor conditions, and transportation. By booking or participating in an activity, you acknowledge and accept these risks.
To the fullest extent permitted by law, you agree that Native Experience, its staff, partners, and affiliates shall not be liable for any injury, accident, illness, loss, or damage incurred during participation, except where caused by gross negligence or willful misconduct.
You may be required to sign a separate waiver before participating in certain activities. Refusal to sign may result in denial of participation without refund.
8. Insurance Disclaimer
Participants are responsible for obtaining their own travel, medical, or accident insurance prior to engaging in any activity. Native Experience does not provide insurance coverage and shall not be responsible for any costs related to accidents, injuries, medical treatment, evacuation, or loss of personal property.
9. Prohibited Activities
You may not use the Site or Services to:
Engage in fraudulent, unlawful, or harmful conduct.
Send spam, unsolicited messages, or harmful code.
Harass, abuse, or threaten others.
Attempt to bypass Site security measures.
Use automated systems to scrape or overload our servers.
10. Third-Party Services
We may work with independent guides, transport providers, or other third parties to deliver certain activities. While we select partners carefully, we are not responsible for their actions, omissions, or services.
11. Termination
We may suspend or terminate your access to the Site or Services at our discretion, without notice, for violation of these Terms or for any reason we deem necessary.
12. Disclaimer of Warranties
The Site and Services are provided on an “as-is” and “as-available” basis. We make no warranties, express or implied, regarding the Site, Services, or any content, including the availability, reliability, or suitability of activities.
13. Limitation of Liability
To the fullest extent permitted by law:
Native Experience shall not be liable for indirect, incidental, special, or consequential damages.
Our total liability for any claim shall not exceed the amount you paid for the Service giving rise to the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless Native Experience, its employees, and partners from any claims, damages, or expenses arising out of your use of the Site, participation in activities, or violation of these Terms.
15. Modifications to Services
We may update, suspend, or discontinue any part of the Site or Services at any time without notice.
16. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Sri Lanka.
Any disputes shall first be attempted to be resolved amicably. If unresolved, disputes shall be submitted to mediation or arbitration in Colombo, Sri Lanka, before resorting to court proceedings.
17. Changes to Terms
We reserve the right to update these Terms at any time. Updates will be posted on this page with a revised “Last Updated” date. Continued use of the Site after updates constitutes acceptance of the revised Terms.
